Terms of Service

Please read these Terms of Service carefully before using Pupnex. These Terms constitute a legally binding agreement between you and Pupnex Group LLC.

1. Acceptance of Terms

By accessing or using the Pupnex website, mobile applications, or any related services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use the Platform. We reserve the right to modify these Terms at any time. We will notify you of material changes by posting a notice on our website. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.

2. Use of the Platform

You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you meet this age requirement. You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree not to: Use the Platform in any way that violates applicable federal, state, or local laws or regulations. Attempt to gain unauthorized access to any portion of the Platform or any systems connected to it. Transmit any unsolicited commercial communications or spam. Impersonate any person or entity or misrepresent your affiliation with any person or entity. Use automated tools, bots, or scrapers to access or collect data from the Platform without our prior written consent.

3. Puppy Reservations & Purchases

All puppy reservations are subject to availability and confirmation by Pupnex. When you complete a reservation, you agree to the following: **Payment:** Full payment or an approved payment plan must be completed before delivery is arranged. **Accuracy:** You are responsible for providing accurate delivery and contact information. **Non-transferability:** Reservations are non-transferable without Pupnex's prior written consent. **Cancellations:** Cancellation policies vary based on the stage of the reservation. See our Cancellation Policy for details. Pupnex connects families with healthy, ethically sourced puppies. Every puppy is backed by our 10-Year Health Commitment, and all partners are independently screened and held to strict welfare standards.

4. 10-Year Health Commitment

Pupnex offers an industry-leading 10-Year Genetic Health Commitment on every puppy purchased through our platform. This commitment covers hereditary and congenital conditions as specified in our Health Guarantee documentation provided at purchase. The commitment does not cover conditions resulting from: Accidents, injuries, or trauma. Improper care, neglect, or abuse. Infectious diseases unrelated to genetic conditions. Routine wellness and preventive care. Claims must be supported by a licensed veterinarian's written diagnosis and submitted to our Health Team within the applicable timeframe.

5. Delivery & Acceptance

Pupnex coordinates puppy delivery through licensed, climate-controlled transportation partners. By accepting delivery, you acknowledge that you have received the puppy described in your reservation and that the puppy appears healthy and consistent with the reservation details. You agree to take the puppy to a licensed veterinarian within 72 hours of delivery. Failure to do so may affect eligibility under the Health Commitment.

6. Intellectual Property

All content on the Platform, including text, graphics, logos, images, audio, and software, is the property of Pupnex or its content suppliers and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works from any Platform content without our prior written consent.

7. User Content

If you submit reviews, photos, or other content to the Platform ("User Content"), you grant Pupnex a worldwide, royalty-free, perpetual license to use, reproduce, display, and distribute your User Content in connection with our services. You represent that your User Content does not violate any third-party rights, is not defamatory or misleading, and complies with all applicable laws. We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate.

8. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, PUPNEX DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PUPNEX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Our total liability to you for any claims arising from your use of the Platform shall not exceed the amount you paid to Pupnex in the twelve months preceding the claim.

10. Governing Law & Disputes

These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that either party may seek injunctive relief in any court of competent jurisdiction. Nothing in these Terms affects your statutory rights as a consumer under applicable UK or Irish consumer protection legislation.
